LABOR-MANAGEMENT RELATIONS COMMITTEE MEETING
SUMMARY OF MEETING HELD 8/24/05

OLD BUSINESS (All Union Agenda Items)
1. Personnel policy and/or practice concerns:
Training (in-house training and external seminars)
Mgt. believes that the Training Branch is currently evaluating training programs for staff and whether the employees can earn CPE/CLE credits from these programs.
Mgt.’s training policy for external training and the selection of employees to attend it is based on the Merit principles (assignment of work). The Union requested Mgt. to tell employees (via email) how the employees were selected to attend the external training. Mgt. will again discuss this specifically with the appropriate official in the Division of Corporation Finance.
Designated December SEC Holiday Party
Revision of previous summary on this issue. It is the SEC policy that the holiday party begins officially at 2 PM. Employees are allowed to attend all invited parties during duty hours unless their attendance with interfere with the SEC mission.
NEW BUSINESS (All Union Agenda Items)
1. Communications between management and bargaining unit employees:
Merit Pay
The Union informed Mgt. the following concerns of employees over the merit pay calendar:
a. There needs to be a due date for the notification of the merit pay that will not revised. Next year the due date should be set so a revision is not necessary. The date should consider possible supervisor vacations, etc. Revising the due date twice implies to the employees that they are not respected. Merit pay is very important to employees. Employees assumed that the due date for them to turn in their contribution statement could not be extended and could not understand why Mgt. due date was extended.
b. Employees want to know what is meant by “being reviewed by my office in an effort to ensure consistency” as stated in the Memo dated 8/4/05 to all employees from Jeff Risinger, AED. What does “ensure consistency” mean?
Mgt. has not changed the date that the merit pay will be reflected in the employees’ paychecks. Merit pay will be effective on 8/21/05 and will be included in the paycheck issued on 9/13/05 as stated in the calendar.
2006 Annual Pay Adjustment
Appears Congress will pass a 3.1% COLA for federal employees. The compensation issues are currently being negotiated with the Union (in impasse and with the FLRA). Mgt. can not provide any information on the 2006 COLA.
Station Place- Phase II
Mgt. has not received any information that there will be a delay the completion of Phase II. The scheduled completion date is the first quarter of 2006.
2. Personnel policy and/or practice concerns:
Training
Mgt. will follow-up with the Training Branch to see if the SEC plans to telecast the AICPA SEC Conference held on December 5-7 to the Headquarters Auditorium and/or other locations.
Mgt. will inform the Training Branch about the employees request for the SEC University to examine the possibility of employees taking CPE/CLE courses available from AICPA and/or ABA at no cost to the employees.
Mgt. will inform the Training Branch about the employees request for the SEC University to focus on courses that apply to duties of employees (e.g. accountants, attorneys, paralegals, compliance examiners and administrative staff in each division). Also, these courses allow employees to earn CPE/CLE credits or other professional credits.
Mgt. informed the Union that administrative time to attend external training including SEC Learning Center/SEC University is processed using Form 1082.
Mgt. will follow-up with the Training Branch to see if the E-Learning Center survey was given to all employees.
The Union requested that Mgt. consider webcasting all training sessions at Headquarters so staff in the regional offices and teleworking can participate in the training sessions and earn CPE/CLE credits. The Union understands that a cost-benefit analysis needs to be performed.
Telework
Mgt. informed the Union that all employees should apply for telework if they believe their positions will allow it.
Time and Attendance
Mgt. informed the Union that it is the supervisor’s discretion to require an employee to charge leave if they arrive 15 minutes late. The supervisor can allow the employee work 15 minutes later that day to avoid being charged leave.
Lunch Break
Mgt. informed the Union that it is permissible for an employee to view their personal TV or listen to their personal radio during their lunch break in their own office or workstation as long as it does not interfere with other employees performing their duties (e.g., private office, earphones, etc.)
Per CBA, employee’s lunch break “normally” should be taken between 11:30 a.m. and 2:30 p.m. Mgt. informed the Union that this lunch break can be adjusted occasionally by an employee with supervisory approval due to the SEC mission.
Staff Meeting
Mgt. informed the Union that Mgt. can not require staff at their own cost to provide refreshments for staff meetings.
Station Place
Mgt. will follow-up about the status of wireless agreements with carriers to allow cell phones to work in building.
NEW BUSINESS (Management Agenda Item)
1. Management wanted to know who to contact if the President is not available. The Union informed management that after the President, they should contact the Vice President and then the Treasurer.
